Turnovi - Vacation Rentals & Management
Thanks for your business and we hope you enjoy your stay in our property!

These Terms & Conditions (“Terms”) constitute a legally binding agreement between the individual making a reservation or otherwise using the services described herein (“Guest,” “you,” or “your”) and turnovi (“turnovi,” “we,” “us,” or “our”).

These Terms apply to reservations, vacation rental stays, direct-booking transactions, websites operated by turnovi, guest communications, use of turnovi-managed properties and amenities, and related services.

By making a reservation, submitting payment, clicking an acceptance box, selecting “Book,” “Reserve,” “Confirm,” “Pay,” or similar language, electronically signing a rental agreement, accessing a turnovi-managed property, or otherwise accepting or using the services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you should not complete a reservation or use the applicable services.

1. BOOKING GUEST RESPONSIBILITY

The individual completing the reservation is the responsible booking guest and must be at least 25 years of age at the time of booking and throughout the reservation.

The booking guest represents and warrants that all information provided in connection with the reservation is truthful, accurate, and complete.

The booking guest is responsible for:

The conduct of every person occupying or visiting the property
Ensuring all occupants and visitors comply with these Terms
All charges associated with the reservation
Damage caused by any occupant, visitor, pet, or invitee
HOA, community, resort, municipal, or other fines resulting from the actions of the booking party
Violations of property rules by any occupant or visitor.
A violation by any member of the booking party or visitor will be treated as a violation by the booking guest.

2. MINIMUM AGE

The primary booking guest must be at least 25 years old.
turnovi may require age or identity verification before or during a reservation.
Misrepresentation of age or identity may result in cancellation or termination of the reservation without refund to the maximum extent permitted by law.

3. PAYMENT TERMS

Unless otherwise disclosed during booking:
51% of the reservation total is due at the time of booking.
The remaining balance is due 31 days before the scheduled arrival date.
If a reservation is made within 31 days of arrival, the full amount may be due at booking.
Guest authorizes turnovi and its payment processors to charge the payment method provided for amounts legitimately due under the reservation and these Terms.
Failure to make required payments may result in cancellation of the reservation.

4. CANCELLATION POLICY

Unless a different cancellation policy is expressly disclosed for a particular reservation:
Cancellations more than 30 days before arrival
Reservations canceled more than 30 days before the scheduled arrival date are eligible for a full refund of amounts paid toward the reservation, except for amounts expressly identified as nonrefundable where permitted by law.
Cancellations within 30 days of arrival
Reservations canceled 30 days or less before the scheduled arrival date are nonrefundable.
This policy is firm.
Weather, illness, transportation issues, changes in travel plans, ski conditions, resort operations, family emergencies, road conditions, flight disruptions, or other circumstances affecting a guest's ability or desire to travel do not alter the cancellation policy unless otherwise required by law.
For this reason, turnovi strongly recommends purchasing travel protection.

5. TRAVEL PROTECTION

Travel protection may be offered through Rental Guardian, Travel Guardian, or another independent third-party travel protection provider.
Travel protection is strongly recommended because turnovi's cancellation policy is firm.

The purchase, administration, coverage, exclusions, eligibility, claims process, approval or denial of claims, reimbursement, and all other aspects of travel protection are governed exclusively by the applicable third-party provider and its policy terms.

turnovi is not the insurer and does not determine whether a claim is approved or denied.

turnovi is not responsible for the actions, omissions, decisions, delays, coverage determinations, or claim-handling practices of any travel protection provider.

Questions and claims relating to travel protection must be directed to the applicable provider.

Most US states have adopted insurance rules and regulations which regulate the activities of
retailers offering travel insurance programs. A registered Travel Retailer is authorized to operate under, and on behalf of, another entity with a Limited Lines Travel Insurance Producer (“LLTIP”) license, such as InsureStays, if the Travel Retailer agrees to adhere to basic guidelines and consumer protections.

In states that have not adopted an authorization process which permits Travel Retailers to operate under an LLTIP entity, Travel Retailers must possess the appropriate license(s) in order to transact travel insurance business. If they do not, they may only refer interested parties to appropriately licensed agents.

You should know the travel protection plans offered and disseminated by authorized Travel Retailers of InsureStays or sold by InsureStays provide insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies as well as any other insurance protection plans you may have coverage under. If you have any questions about your current coverage, call your insurer or insurance agent or broker.

Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer. As an authorized Travel Retailer of InsureStays, no employee of the Travel Retailer is qualified or authorized to:

(a) Provide technical explanations, representations, or interpretations, or answer technical
questions about, coverage provisions, benefits, exclusions, terminology and/or conditions of any of the insurance policies sold by InsureStays;
(b) Evaluate the adequacy of the prospective insured’s or travel/rental guest’s current existing
insurance coverage;
(c) Otherwise advertise, hold out or present themselves in such a way as to be perceived as a
fully licensed agent or as an insurance expert.
Travel Retailers are not licensed insurance producers, agents, or insurance experts. Travel Retailers may only provide general information such as a description of the coverage provided and the price. Travel Retailers can also process your application and collect your premiums. Travel Retailers cannot answer specific questions about your policy. Any questions you have about your policy, including coverage, benefits, exclusions, terminology, and/or conditions should be directed to InsureStays and/or to the insurance carrier underwriting the policy.

Similarly, any questions you may have as to your current existing insurance coverage, or the adequacy of such coverage, should be directed to InsureStays or other licensed insurance producer/agent/agency.
Travel Retailers may receive related compensation for various items, including marketing, technology and/or referrals in connection with travel insurance products displayed in certain jurisdictions.

NOTICE TO ALABAMA and ARIZONA RESIDENTS

1. This plan provides insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies. If you have any questions about your current coverage, call your insurer or insurance agent or broker.
2. Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer. If not individually licensed, the Travel Retailer’s employee is not qualified or authorized to: (a) answer technical questions about the benefits, exclusions, and conditions of any of the insurance offered by the Travel Retailer; (b) evaluate the adequacy of the prospective insured’s existing insurance coverage

NOTICE TO CALIFORNIA RESIDENTS

1. This plan provides insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies. If you have any questions about your current coverage, call your insurer or insurance agent or broker.
2. Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer.
3. If not individually licensed, that the Travel Retailer's employee is not qualified or authorized to:  
(i) Answer technical questions about the benefits, exclusions, and conditions of any of the insurance offered by the Travel Retailer.
(ii) Evaluate the adequacy of the prospective insured's existing insurance coverage.

NOTICE TO DELAWARE RESIDENTS

The coverage offered may duplicate existing coverage you have. You may wish to compare the terms of this policy with your existing life, health, home, and automobile policies, and other insurance policies or sources of protection.

NOTICE TO TEXAS RESIDENTS

1. This plan provides insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this insurance coverage with your existing life, health, home, and automobile insurance policies. If you have any questions about your current coverage, call your insurer or insurance agent or broker.
2. Purchasing travel insurance is not required in order to purchase any other product or service offered by the Travel Retailer. If not individually licensed, the Travel Retailer’s employee is not qualified or authorized to:
(a) evaluate or interpret technical words or phrases used in a travel insurance policy or benefits under or terms of the policy;
(b) Evaluate or provide advice related to a traveler’s existing insurance coverage; or (c) be considered as a license holder or an insurance expert.

NOTICE TO NEW YORK RESIDENTS

The licensed producer represents the insurer for purposes of the sale. Compensation paid to the producer may depend on the policy selected, or the producer's expenses, volume of business, or profitability. The purchaser may request and obtain information about the producer's compensation, except as otherwise provided by law.

NOTICE TO MARYLAND RESIDENTS

The purchase of travel insurance would make the travel insurance coverage primary to any other duplicate or similar coverage. The Commissioner may be contacted to file a complaint at: Maryland Insurance Administration, ATTN: Consumer Complaint Investigation Property/Casualty, 200 St. Paul Place, Suite 2700, Baltimore, MD 21202.

6. DAMAGE PROTECTION

Damage protection is required for every direct & VRBO reservation unless otherwise expressly stated.
The damage protection program is provided through Rental Guardian or another third-party provider and may provide coverage for qualifying accidental damage to the contents or property, subject to the terms, exclusions, limitations, and requirements of the applicable protection plan.
Damage protection does not eliminate the guest's responsibility for damage.

Guests remain financially responsible for:

Damage not covered by the protection plan
Damage exceeding applicable coverage limits
Intentional or malicious damage
Damage caused by prohibited conduct
Damage caused by unauthorized animals or occupants
Theft or removal of property
Fines
Excessive cleaning
Missing items
Damage excluded by the applicable protection plan
Any other amount for which the guest is responsible under these Terms.
Coverage determinations are made by the applicable third-party provider, not turnovi.

7. CHECK-IN AND CHECKOUT

Standard check-in time is 4:00 PM.
Standard checkout time is 10:00 AM.
Early check-in and late checkout are not guaranteed unless expressly approved by turnovi.
Guests remaining in the property after checkout without authorization may be charged additional fees, including costs associated with delayed cleaning, staffing, relocation of incoming guests, or other losses resulting from the unauthorized occupancy.

8. MAXIMUM OCCUPANCY

Each property has a maximum permitted occupancy disclosed in the property listing, reservation materials, or rental agreement.
The maximum occupancy may not be exceeded at any time without prior written authorization from turnovi.
Unauthorized occupants or visitors exceeding the permitted occupancy may result in immediate termination of the reservation and removal from the property, without refund to the maximum extent permitted by law.

9. PARTIES AND EVENTS

Parties, receptions, events, gatherings exceeding permitted occupancy, and other unauthorized group activities are prohibited unless expressly approved in writing by turnovi.
Unauthorized parties or events may result in immediate termination of the reservation without refund and may result in additional charges for:
Cleaning
Damage
Security response
HOA or community fines
Law-enforcement response
Staff time
Neighbor complaints
Repairs
Lost revenue
Other reasonable costs resulting from the violation.

10. PET POLICY

Dogs are permitted only at properties specifically designated as pet-friendly.
Each pet-friendly property may have its own maximum number of permitted dogs.
Unless otherwise disclosed, the pet fee is $99 per dog.
Guests traveling with dogs must:
Disclose all dogs before arrival
Pay all applicable pet fees
Follow the property's pet limits
Keep dogs under reasonable control
Clean up all pet waste inside and outside the property
Properly dispose of pet waste
Prevent damage to furniture, linens, flooring, landscaping, and other property
Follow HOA and community pet rules.
Cats, hamsters, and other pets are not permitted. Dogs only.
Unauthorized animals may result in immediate termination of the reservation, removal from the property, additional cleaning charges, remediation costs, and other applicable charges.

11. SERVICE ANIMALS AND EMOTIONAL SUPPORT ANIMALS

turnovi complies with applicable disability-access laws.
A qualifying service animal will be accommodated as required by applicable law, including at properties that otherwise prohibit pets.
A qualifying service animal is not considered a pet, and no pet fee will be charged solely because a guest uses a qualifying service animal.
Where permitted by law, turnovi may ask the limited questions permitted under applicable disability law when it is not apparent that an animal is a service animal.
turnovi will not require certification, identification cards, or other documentation that applicable law prohibits us from requiring.
A service animal must remain under the handler's control and may be required to leave if permitted by applicable law, including if the animal is out of control and the handler does not take effective action or if the animal is not housebroken.
Guests remain responsible for actual damage caused by a service animal to the same extent that any guest would be responsible for damage they cause.
Animals whose sole purpose is emotional support, comfort, therapy, companionship, or emotional well-being are generally not service animals under the Americans with Disabilities Act.
Emotional support animals, therapy animals, and other non-service animals are therefore subject to the property's applicable pet rules and fees unless another law specifically requires a different accommodation.

12. SMOKING AND VAPING

Smoking and vaping are strictly prohibited inside all turnovi-managed properties.
This includes cigarettes, cigars, marijuana, electronic cigarettes, vaping devices, and similar products.
Smoking or vaping must occur at least 25 feet away from the home.
Cigarette butts, vaping materials, ashes, or other smoking-related waste may not be discarded in yards, landscaping, decks, patios, fire pits, or other areas of the property.
Guests may be charged for smoke remediation, odor removal, excessive cleaning, damage, replacement of affected materials, or other resulting costs.

13. HOT TUBS

Where a property includes a hot tub, use is entirely at the guest's own risk.
Hot tubs are professionally serviced as part of turnovi's operating procedures; however, water quality, temperature, mechanical systems, and availability may be affected by guest use, weather, equipment failure, power outages, or other circumstances.
Guests may not tamper with hot tub equipment, drain the tub, add unauthorized chemicals, misuse covers or controls, or otherwise interfere with normal operation.
Guests must follow all posted or provided hot tub instructions.
Additional service, cleaning, chemical treatment, draining, refilling, repair, or remediation required because of guest misuse may be charged to the booking guest.
turnovi does not guarantee uninterrupted hot tub availability.

14. HOA, COMMUNITY, AND RESORT RULES

Many turnovi-managed homes are located within private communities, homeowners associations, resort communities, condominium associations, or other governed developments.

Guests must comply with all applicable rules concerning:

Quiet hours
Parking
Pools
Common areas
Trash
Pets
Vehicles
Shuttles
Amenities
Recreational areas
Occupancy
Conduct
Resort access
Other community requirements.

Rules may be changed by the applicable HOA, community, resort, or other third party without notice to turnovi.
The booking guest is solely responsible for any fine, citation, ticket, towing fee, penalty, assessment, or charge resulting from the actions of the guest, occupants, visitors, or vehicles associated with the reservation.

15. PARKING AND VEHICLES

Guests must follow all property, HOA, resort, municipal, and community parking restrictions.

turnovi is not responsible for:

Parking tickets
Towing
Vehicle damage
HOA fines
Snow-related towing
Unauthorized parking enforcement
Other consequences resulting from parking violations.
The booking guest is responsible for all such charges caused by their party.

16. QUIET HOURS AND NEIGHBOR CONDUCT

Guests must respect neighboring homes and communities.
Quiet hours disclosed for the property or established by the applicable HOA or municipality must be observed.
Excessive noise, disruptive behavior, repeated complaints, threatening conduct, or unreasonable interference with neighbors may result in immediate termination of occupancy without refund.

17. PROPERTY DAMAGE

Guests are responsible for damage caused by themselves, occupants, visitors, or animals associated with their reservation.

This may include damage to:

Furniture
Appliances
Electronics
Linens
Hot tubs
Doors
Windows
Flooring
Walls
Landscaping
Recreational equipment
Smart-home devices
Community property
Any other property.
Guest agrees to promptly report damage.
Failure to report damage may affect eligibility under applicable damage-protection programs and may result in additional liability.

18. EXCESSIVE CLEANING

Guests are expected to leave the property in reasonably acceptable condition and comply with checkout instructions.
Additional cleaning fees may be charged when extraordinary cleaning is required because of:
Excessive trash
Bodily fluids
Pet waste
Smoking
Food or grease
Unauthorized animals
Excessive mess
Furniture relocation
Confetti or decorations
Failure to follow checkout requirements
Other conditions substantially beyond normal turnover cleaning.

19. LOST OR MISSING ITEMS

Guests may be charged for lost, damaged, or missing property, including:

Pool passes
Community passes
Keys
Remotes
Access devices
Parking permits
Amenity passes
Smart-device accessories
Other property belonging to turnovi or a property owner.
Applicable charges may include actual replacement cost and reasonable administrative or service costs.

20. RIGHT OF ENTRY

turnovi, property owners, employees, contractors, vendors, maintenance personnel, pest-control providers, emergency personnel, utility providers, HOA personnel, and other authorized parties may enter a property when reasonably necessary.

Reasons may include:

Emergencies
Maintenance
Repairs
Safety concerns
Inspections
Property protection
Pest control
Utility issues
Suspected rule violations
Preventing damage
Responding to guest requests
Compliance with legal or HOA requirements.

Advance notice will be provided when reasonably practicable, but notice may not always be possible or required in emergencies or other urgent circumstances.

21. GUEST CONDUCT AND REMOVAL

turnovi may terminate a stay and require guests to vacate the property when turnovi reasonably determines that a material violation of these Terms has occurred.

Grounds may include:

Illegal activity
Threats or violence
Dangerous conduct
Unauthorized parties
Excessive occupancy
Unauthorized animals
Property damage
Repeated noise complaints
Harassment of staff, contractors, neighbors, or owners
Interference with security or smart-home devices
Refusal to comply with legitimate safety instructions
Material violation of HOA or community rules.
Where permitted by law, termination for material guest misconduct may occur without refund.

22. EXTERIOR CAMERAS AND SMART-HOME TECHNOLOGY

turnovi-managed properties may use lawful smart-home, security, and property-management technology.

Such technology may include:

Exterior security cameras
Doorbell cameras
Smart locks
Electronic entry systems
Thermostats
Wi-Fi systems
Routers
Televisions
Noise-monitoring devices
Leak detectors
Environmental sensors
Other property-management or security technology.

turnovi does not knowingly install or operate cameras in private interior living spaces such as bedrooms or bathrooms.
Exterior cameras may monitor exterior entrances, driveways, parking areas, yards, decks, common areas, or other exterior portions of a property where lawful.

Guests may not disable, obstruct, unplug, cover, tamper with, or damage security, safety, internet, smart-lock, thermostat, or property-management technology.

23. WI-FI, NETWORK DATA, AND PRIVACY

Use of Wi-Fi at participating turnovi-managed properties is subject to turnovi's Privacy Policy.
When you connect to a property network, technical or identifying information may be collected, including IP addresses, device identifiers, device information, connection information, network activity metadata, login information, or information voluntarily submitted through a Wi-Fi portal.

Where permitted by law, turnovi may use this information for:

Network administration
Security
Fraud prevention
Guest analytics
Improving services
Marketing analysis
Audience development
Advertising and remarketing turnovi properties or services.
By voluntarily using a turnovi-managed Wi-Fi network, you acknowledge and agree to the collection and use of network-related information as described in the turnovi Privacy Policy.
Use of Wi-Fi does not constitute consent to receive automated marketing calls or text messages where separate consent is required by law.
Any such communications requiring separate consent will be handled through an appropriate consent mechanism.

24. INTERNET, UTILITIES, AND SERVICE INTERRUPTIONS

Vacation rental properties may experience interruptions in:

Internet
Wi-Fi
Electricity
Water
Cable television
Streaming services
Cellular reception
Propane
Heating
Air conditioning
Other utility or technology services.
Mountain weather, storms, fallen trees, utility failures, provider outages, infrastructure limitations, maintenance, and other circumstances may affect these services.

turnovi will make reasonable efforts to assist when appropriate but does not guarantee uninterrupted availability of utilities or third-party services.
Unless otherwise required by law, temporary outages or interruptions outside turnovi's reasonable control do not automatically entitle a guest to a refund.

25. MOUNTAIN CONDITIONS, WEATHER, AND ROADS

Many turnovi-managed properties are located in mountain and rural areas of Pennsylvania.

Guests acknowledge that conditions may include:

Snow
Ice
Heavy rain
Fog
Wind
Falling branches
Steep roads
Gravel roads
Limited cellular service
Power outages
Limited municipal services
Rapidly changing weather.

Guests are responsible for selecting an appropriate vehicle, monitoring weather and road conditions, and making reasonable travel decisions.
turnovi does not guarantee road accessibility, weather conditions, snow accumulation, or uninterrupted travel to or from a property.

26. SKIING, RESORTS, AND THIRD-PARTY AMENITIES

Descriptions such as “near Seven Springs,” “Hidden Valley,” “ski-in/ski-out,” “resort,” “shuttle,” “golf,” “pool,” or similar references do not constitute a guarantee that any third-party facility or amenity will operate during your stay.

turnovi does not control:

Ski conditions
Snowmaking
Lift operations
Resort hours
Resort closures
Pools
Golf courses
Shuttle service
Restaurants
Shops
Attractions
Community amenities
Third-party recreational services.
Third-party services may be modified, restricted, closed, delayed, or discontinued without notice.
Unless otherwise required by law, such changes do not automatically entitle a guest to cancellation or refund.

27. WILDLIFE, PESTS, AND NATURAL CONDITIONS

Guests acknowledge that mountain and rural environments naturally include wildlife, insects, and other pests.

Possible encounters may include:

Bears
Deer
Snakes
Mice
Bats
Spiders
Bees
Wasps
Flies
Gnats
Other insects or wildlife.

The presence of naturally occurring wildlife or an isolated insect or pest does not necessarily indicate that a property is improperly maintained.
Guests must not intentionally feed or approach wildlife.
turnovi may use professional pest-control services but cannot guarantee that wildlife, insects, or pests will never enter or appear near a vacation rental property.

28. ASSUMPTION OF RISK

Guests acknowledge that vacation rental properties and surrounding mountain environments contain inherent and potentially serious risks.

These may include risks associated with:

Stairs
Decks
Balconies
Hot tubs
Pools
Fireplaces
Fire pits
Grills
Snow and ice
Wet surfaces
Hiking
Skiing
Sledding
Golf
Water features
Streams
Ponds
Woods
Wildlife
Recreational equipment
Uneven terrain
Weather
Other indoor and outdoor activities.

To the fullest extent permitted by applicable law, Guest voluntarily assumes all ordinary and inherent risks associated with the use and occupancy of the property, amenities, surrounding land, and participation in recreational activities.
Guests are responsible for supervising children and other members of their party and for determining whether an activity or amenity is appropriate for them.
Nothing in this section waives liability that cannot legally be waived.

29. PERSONAL PROPERTY

Guests are solely responsible for their personal belongings.

To the fullest extent permitted by law, turnovi and property owners are not responsible for personal property that is:

Lost
Stolen
Damaged
Destroyed
Misplaced
Left behind.

Guests should secure valuables and vehicles appropriately.
turnovi cannot guarantee that items left behind can be located, stored, returned, or shipped.
turnovi does not provide a guaranteed lost-item shipping service and is not responsible for returning items left at a property.

30. PROPERTY UNAVAILABILITY AND SUBSTITUTION

Circumstances may occasionally make a reserved property unavailable.

Examples include:
Fire
Flood
Mechanical failure
Structural problems
Utility failure
Government order
Safety concerns
Property sale
Owner action
Severe weather
Natural disaster
Other circumstances beyond turnovi's reasonable control.

Where reasonably possible, turnovi may offer:

An alternative property
Modified reservation arrangements
A refund of affected amounts
Another reasonable solution.
The appropriate remedy will depend on the circumstances.
To the fullest extent permitted by law, turnovi will not be liable for consequential, incidental, indirect, special, or other damages arising from circumstances making a property unavailable.

31. FORCE MAJEURE

turnovi will not be responsible for failure or delay in performing obligations caused by circumstances beyond its reasonable control.

These circumstances may include:

Severe weather
Natural disasters
Fire
Flood
Pandemic
Epidemic
Government restrictions
War
Terrorism
Civil unrest
Labor disruptions
Road closures
Utility failures
Internet outages
Supplier failures
Transportation interruptions
Acts of God
Other similar events.
Refund rights, if any, remain subject to applicable law and the cancellation terms applicable to the reservation.

32. CHARGEBACKS AND PAYMENT DISPUTES

Guests agree to make a good-faith effort to contact turnovi concerning legitimate billing disputes before initiating a chargeback where reasonably practicable.
Fraudulent, knowingly false, or bad-faith chargebacks are prohibited.
turnovi reserves the right to submit reservation records, guest communications, access logs, signed agreements, photographs, inspection records, transaction records, and other relevant evidence to financial institutions, payment processors, courts, arbitration providers, law enforcement, or other appropriate parties in connection with disputed charges.
Nothing in this section waives a consumer's lawful right to challenge a charge.

33. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, turnovi, Toasted Elements LLC, property owners, and their respective members, managers, employees, agents, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to a reservation, property, website, amenity, third-party service, or these Terms.
To the maximum extent permitted by law, any liability of turnovi arising from a particular reservation shall not exceed the amount actually paid directly to turnovi for that reservation, except where a different limitation is required by applicable law.
Nothing in these Terms limits liability that cannot lawfully be excluded or limited.

34. INDEMNIFICATION

To the fullest extent permitted by law, Guest agrees to defend, indemnify, and hold harmless turnovi, Toasted Elements LLC, applicable property owners, and their members, managers, employees, agents, contractors, and affiliates from claims, losses, damages, liabilities, fines, penalties, costs, and reasonable legal expenses arising from or related to:

Guest's breach of these Terms
Conduct of occupants or visitors
Property damage
Unauthorized animals
Unauthorized parties
Illegal activity
HOA or community violations
Injuries or claims caused by Guest's negligent or wrongful conduct
Misuse of the property or amenities.
This provision does not require indemnification for liability that applicable law prohibits turnovi from shifting to the guest.

35. WEBSITE USE

All turnovi website content, including photographs, videos, text, logos, descriptions, graphics, property information, design, and other materials, is owned by or licensed to turnovi unless otherwise indicated.
Users may not, without authorization:
Copy or commercially reproduce content
Scrape property or pricing information
Use automated extraction tools
Impersonate turnovi
Interfere with website security
Attempt unauthorized access
Use website content for misleading or unlawful purposes
Infringe intellectual-property rights.
Website content may contain errors or become outdated.
turnovi may modify, remove, or update website content without notice.

36. THIRD-PARTY LINKS AND SERVICES

turnovi may provide links or access to third-party services.
turnovi does not control and is not responsible for the availability, security, privacy, terms, accuracy, products, services, or actions of third parties.
Use of third-party services is at the user's discretion and subject to the applicable provider's terms.

37. ELECTRONIC COMMUNICATIONS AND SIGNATURE

Guest consents to conducting transactions electronically.
Electronic acceptance of these Terms, electronic payment, clicking an acceptance checkbox, or completing an online booking constitutes an electronic signature and agreement to be bound by these Terms to the extent permitted by law.
Guest agrees that electronic records may satisfy legal requirements that communications or agreements be in writing.

38. DISPUTE RESOLUTION — BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for matters that cannot lawfully be subject to arbitration and except as otherwise stated below, Guest and turnovi agree that disputes, claims, or controversies arising out of or relating to these Terms, a reservation, a property stay, payments, services, or the relationship between Guest and turnovi will be resolved through individual binding arbitration rather than a jury trial.
The arbitration shall take place in Pennsylvania unless the parties mutually agree otherwise.
The arbitrator shall have authority to award any individual remedy available under applicable law but may not consolidate claims of multiple unrelated persons except where applicable law requires otherwise.
Either party may pursue an eligible claim in small claims court where permitted.
Nothing in this section prevents either party from seeking temporary or emergency injunctive relief from a court of competent jurisdiction where necessary to protect persons, property, intellectual property, or confidential information.
If the arbitration provision is determined to be unenforceable as to a particular dispute, that dispute shall be resolved in an appropriate court located in Pennsylvania, to the extent permitted by law.

39. CLASS-ACTION AND JURY-TRIAL WAIVER

TO THE FULLEST EXTENT PERMITTED BY LAW, GUEST AND TURNOVI AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

To the fullest extent permitted by law, Guest and turnovi also knowingly waive the right to trial by jury for disputes subject to this agreement.
If applicable law prohibits enforcement of part of this waiver, the remaining enforceable provisions will remain effective.

40. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law principles, except where federal law controls.
For disputes that are not required to be arbitrated, Guest agrees that exclusive venue and jurisdiction shall lie in an appropriate state or federal court located in Pennsylvania, to the fullest extent permitted by law.

41. SEVERABILITY

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in full force and effect.

42. NO WAIVER

Failure by turnovi to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or turnovi's right to enforce it later.

43. ENTIRE AGREEMENT

These Terms, together with the applicable reservation details, property rules, rental agreement, Privacy Policy, and any other terms expressly incorporated into the reservation, constitute the agreement between the parties concerning the reservation and related services.
If a property-specific rule conflicts with these general Terms, the more specific rule may control with respect to that property unless prohibited by law.

44. CHANGES TO THESE TERMS

turnovi may update these Terms from time to time.
The version applicable to a reservation will generally be the version accepted in connection with that reservation, except where changes are required by law or otherwise lawfully applied.
The Last Updated date above identifies the most recent version posted on the website.

45. PRIVACY POLICY

Guest use of turnovi websites, booking services, guest Wi-Fi, and other services is also subject to the turnovi Privacy Policy, which describes how personal information may be collected, used, shared, and retained.

RELEASE: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children's or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
